Throughout the site, the terms “we”, “us” and “our” refer to Onirica Cosmetics. Onirica Cosmetics offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all Terms and Conditions stated here.
 
 

Acceptance of the general sales conditions

 
By visiting our website and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions (“Terms of Service”, “Terms”), including those additional terms and policies referenced herein and/or available by hyperlink. These Terms of Service apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/or contributors of content.
 
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service or any contact on the website through which the service is provided, without a written permission by us.
 
Once the online purchase procedure has been completed, it is the responsibility of the Customer to print, save an electronic copy of, or in some way keep these general sales conditions, in accordance with the provisions of articles 3 and 4 of Italian Legislative Decree 185/199 on distance selling.
 
Any right of the Customer to indemnity or compensation for damages, as well as any contractual or non-contractual responsibility for direct or indirect damages to persons and/or property caused by an order not being accepted, even partially, is excluded.
 
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
We reserve the right but are not obligated to limit the sales of our products or services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. 
 
All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.
 
You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

Products information and how to buy

 
The Customer can only buy products that are listed in Onirica Cosmetics’ electronic catalog at the time the order is placed and that can be seen online at https://oniricacosmetics.com/shop/
 
Onirica Cosmetics confirms that the order has been correctly received by sending an email to the email address given by the Customer. This confirmation message will contain the Date and Time the order was placed and a “Customer Order Number”, which should be used in any further communication between the Customer and Onirica Cosmetics. The message contains all the details given by the Customer and it is the responsibility of the Customer to check that they are correct and to communicate any corrections before the order is processed.
In the event that the order is not accepted, Onirica Cosmetics guarantee that the Customer will be promptly informed.

All prices indicated on our online shop should be understood as INCLUDING VAT (22%). 
The prices of the products may change without prior warning.
 

Images

 
The images that appear in the product descriptions are solely for illustrative purposes to give a better idea of the various colors, textures etc. We have made every effort to display as accurately as possible the colors and images of our products, however, we cannot guarantee that your computer monitor’s display will be 100% accurate.

Delivery methods, costs, and reports to customer care

 
Onirica Cosmetics ships to Italy, European Union and other countries outside the EU as listed on our Shipping & Payment page.
 
A receipt along with a document with the order’s summary is attached to every package shipped, as required by Italian Presidential Decree no. 696 of the 21st December 1996. An invoice is only issued if requested when the order is placed, indicating the company name and a valid VAT number in the relevant fields. 
IMPORTANT: It is not possible to request an invoice for an order that has already been dispatched.
 
The costs of delivery are charged to the Customer and are clearly stated when the order is placed. The goods will be paid for by the Customer using the payment method selected when ordering. 
Onirica Cosmetics cannot be held responsible in the event that there is a delay in dispatching or delivering the order.
 
When the goods are delivered by the courier, it is the responsibility of the Customer to check that the packaging, including the sealing material (adhesive tape and/or strapping) is intact, not damaged or otherwise altered. The Customer must immediately report to the courier any damages. Once the Courier’s document has been signed, the Customer may no longer raise any objections concerning the outer packaging of the items delivered. Any problems relating to the physical integrity, correspondence, or completeness of the product must be strictly communicated within 15 days of delivery, as described in this document.
In the event that items that are held in the courier’s warehouses due to repeated unsuccessful delivery attempts to the address given by the Customer are not collected within 5 working days, the order will be automatically canceled.
 
 

Product availability

 
Only products that are available in stock can be ordered on https://oniricacosmetics.com/shop/
 
We strive to keep track of every item in our warehouse to ensure that stock levels are always accurate. However small discrepancies between the stock in the warehouse and what is indicated on the website might occur. As a result, in rare cases, the availability of the items cannot be 100% guaranteed. In the event that one or more items ordered are not immediately available to be shipped, our staff will contact the Customer and offer he or she the following solutions: 
– Immediately dispatch the items that are available and send any missing items as soon as they are available, without charging any extra shipping costs;
– offer the customer the possibility to choose whether to receive all the items together, delaying the dispatch of the order, or to cancel the products that are not immediately available from the order.
 
 

Right to withdraw and return policy

 
If all or part of your order is not satisfactory, you have a period of fourteen (14) days from the date of receipt of the goods in order to exercise your legal right to withdraw and return the product(s) (article 5 of Italian Legislative Decree 185/1999). This right applies only to a consumer (that is, a natural person who buys the goods for purposes not related to his or her professional activities, that is, who does not make the purchase indicating a VAT number on the order form).
All products must always be returned to Onirica Cosmetics in the condition in which they were originally sold so as they may once again be put on sale (products in perfect condition accompanied by their original box, accessories, instructions etc.).
 
 

Returning procedure

 
Notify your intention to return/cancel your order within 14 working days from the date of delivery via e-mail at orders@oniricacosmetics.com specifying the details of the order. 
Once notified of your intention to return a product, our staff will send you the Returns Form via email. After you have printed and completed the form, you will need to insert it inside the package with the items you wish to return.
Items must be returned in protective packaging. All items without defects must be returned in their original packing “as new” with no damage to the product or the packaging. Defective items should be returned in their original packaging. Be sure to have properly sealed the package and to have inserted the Return form. Send the goods to the address indicated in the Returns Form. 
Please be aware that we do not accept parcels sent at the expense of the recipient. 
 
Remember to indicate on the Returns Form all of the necessary data required for a refund, including your email address and your phone number. 
If the purchaser/recipient of the order does not show that they have actually delivered the product to a courier, all risks associated with the return of the product(s) are borne by the purchaser/recipient of the order.
 
You can then in the legal return period:
  • get a discount code equivalent to the amount paid for the return products, for use only on the website of Onirica Cosmetics and valid for one year from the date of issue.
OR
  • get a refund equivalent to the amount paid for the returned products. 
 
 
Onirica Cosmetics is not in any way responsible for damage or theft/loss of goods returned via non-insured shipping. The returned goods will be examined to asses any damage or tampering not caused during transit. In the event that the returned product is damaged, Onirica Cosmetics will retain a percentage of the refund as a contribution towards restoration costs.
 
With the exception of any restoration costs for verified damage to the original packaging, Onirica Cosmetics will refund the customer the total amount already paid for the goods (excluding shipping costs) via Bank Transfer within 14 days of receiving the returned goods. It will be the responsibility of the customer to promptly provide the details of the bank account to which the refund should be paid (name, surname, account holder, IBAN code).
 
The right to withdraw is completely forfeited due to failure to fulfill the essential condition of the integrity of the goods (packaging and/or contents), in the event that Onirica Cosmetics ascertains that:
– integral parts of the product are missing;
– the product has been damaged other than in transit.
In the event that the right to withdraw is forfeited, Onirica Cosmetics will return the purchased goods to the sender and charge the sender for the shipping costs.
 
 

Guarantees

 
Products purchased on https://oniricacosmetics.com are subject to the regulations, in as far as they are applicable, stipulated by Italian Legislative Decree 2.2.2002 no. 24 on sales contracts and guarantees regarding consumer goods, and, in as far as is not provided for therein, to the specific provisions on the subject in the Italian Civil Code.
This guarantee shall apply to products with conformity defects and/or faults that were not identifiable at the time of purchase, as long as the product itself is used correctly and with due diligence, i.e., for its proper purpose and as indicated by any technical documentation, observing any operational rules therein. 
The aforementioned guarantee will not, on the other hand, be applicable in the event of carelessness, negligence in the use or maintenance of the product, or improper use. The guarantee is personal and thus only applicable to the original buyer since it is reserved for direct customers and not retailers.
Any anomalies in the manufacture of the products must be communicated within 15 days of receiving the goods. The customer must attach the written communication when he or she sends the faulty product back. 
In order to be replaced, when it is sent back to Onirica Cosmetics the product, although faulty, must be complete with all its packaging, all the accessories, and the documentation received by the customer at the time of purchase. If the product is returned without the original packaging, accessories, and documentation listed above, Onirica Cosmetics is unable to obtain a replacement product from the manufacturer and the product cannot be replaced.
Onirica Cosmetics reserves the right to verify that the product is, in fact, faulty as claimed by the customer and to only provide a replacement after this check has been carried out. The request will only be dealt with if the returned package contains the following documents: a copy of the purchase invoice or cash on delivery payment receipt, the number and date of the order, and a brief description of the fault found. The costs of returning the goods to the sender are to be born by the Customer.
